Board of Adjustments
The Wahoo Board of Adjustment is a board of five members (with one alternate) appointed by the Mayor and City Council to hear and rule on requests for Variance or appeals where it is alleged an error has been made in enforcement of any zoning regulation. Meetings are held on an as-needed basis.
Notice of meetings are posted on the bulletin board of the City Hall, Post Office, and First National Bank at least 24 hours before the meeting. All Board of Adjustment meetings are open to the public and the agenda shall be available for public inspection at the office of the Zoning Administrator, City Hall, 605 North Broadway, Wahoo, Nebraska during regular business hours.

Application for Variance
The Board of Adjustment may grant variances from strict application of the Zoning Ordinance in cases where dimensional or topographic conditions will result in exceptional practical difficulties or undue hardship to the property owner. Dimensional reasons include exceptional narrowness, shallowness or shape of a specific piece of property, or exceptional topographic conditions which are not shared with other properties in the same vicinity. A concurring vote of four members is required.
No variance shall be authorized unless the Board finds that:
1. The strict application of the Ordinance would produce undue hardship;
2. Such hardship is not shared generally by other properties in the same zoning district and the same vicinity.
3. The authorization of such variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by the granting of the variance; and
4. The granting of such variance is based upon reasons of demonstrable and exceptional hardship, as distinguished from variations for purposes of convenience, profit or caprice.
The Board of Adjustment also may hear and decide appeals where an error is alleged in enforcement of any zoning regulation, or for interpretation of the zoning map.
Decisions of the Board Adjustment may be appealed to the District Court.
